1. Who we are and what we offer

NightingalePrep ("we," "us," "our") provides a paid subscription platform of study materials, practice questions, and interactive tools to help students prepare for the NCLEX-RN exam (United States) and the AHPRA/NMBA Outcomes-Based Assessment (OBA) pathway (Australia). By creating an account or subscribing, you agree to these Terms.

2. Not affiliated with any licensing body

NightingalePrep is an independent, privately-owned exam-preparation company. We are not affiliated with, endorsed by, sponsored by, or acting on behalf of the National Council of State Boards of Nursing (NCSBN), the Nursing and Midwifery Board of Australia (NMBA), or the Australian Health Practitioner Regulation Agency (AHPRA). NCLEX-RN® and NCSBN® are registered trademarks of NCSBN, referenced here only to describe the exam our content helps you prepare for.

3. No guarantee of exam outcome or licensure

Our content is designed to help you study and practice. We do not guarantee that you will pass the NCLEX-RN, the OBA, or receive licensure in any jurisdiction. Exam outcomes depend on many factors outside our control, including your own prior education, clinical experience, and preparation.

4. Not medical or clinical advice

Content on this platform, including practice scenarios and virtual patient simulations, is for exam-preparation and educational purposes only. It is not medical advice and must not be used to make real-world clinical or patient-care decisions.

5. Subscriptions, billing, and cancellation

Subscriptions are billed on a recurring basis and renew automatically — at the end of each billing period (monthly, 3-month, 6-month, or annual, depending on the plan you choose), your saved payment method is charged again for the next period, and this repeats indefinitely until you cancel. You can turn off auto-renewal anytime from your account page, either using the "Turn off auto-renewal" button or Stripe's billing portal; cancellation takes effect at the end of your current paid period, and you keep full access until then — it does not stop your access immediately. New subscribers receive a 3-day free trial with limited sample access to the full platform; a payment method is required to start the trial, you are not charged during the 3 days, and if you don't cancel before the trial ends, your card will be charged automatically for the plan you selected and the subscription will continue auto-renewing from there. All payments are processed securely by Stripe; we do not store your full card details ourselves.

7. Acceptable use

You agree not to: share your account credentials or resell access; scrape, copy, or redistribute our questions, lessons, downloadable materials, or other content; use the platform for any unlawful purpose; or attempt to interfere with the security or normal operation of the platform.

8. Intellectual property

All course content, questions, downloadable materials, software, and branding on this platform are owned by NightingalePrep or our licensors and are protected by copyright and other intellectual property laws. Your subscription grants you a personal, non-transferable license to use the content for your own exam preparation — it does not transfer ownership of anything to you.

9. Reviews and user content

If you submit a review or testimonial, you confirm it reflects your genuine experience and you grant us permission to publish it on the platform. We may decline to publish, or may remove, any review at our discretion.

10. Limitation of liability

To the fullest extent permitted by law, NightingalePrep is not liable for any indirect, incidental, or consequential damages arising from your use of the platform, including exam outcomes or licensure decisions. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose.

11. Changes to these terms

We may update these Terms from time to time. We'll update the "Last updated" date above, and for material changes, make a reasonable effort to notify active subscribers by email.
